Prior to the adoption of workers' compensation programs, injured workers had to prove in court that their injuries were caused by their employers' negligence in order to receive financial compensation. In exchange for this no-fault, employer-provided insurance coverage, employees give up the right to sue their employers for compensation for on-the-job injuries.

Third Party Claims

However, if someone other than your employer or co-workers caused your injuries, you may be able to recover financial compensation from that third party by filing a personal injury lawsuit. These so-called third party claims are generally more financially beneficial to injury victims. Third party claims allow injured people to recover compensation for pain and suffering as well as for medical expenses and lost wages. Workers' compensation does not compensate injured workers for pain and suffering caused by an injury.
