Survivors and dependants of those who die because of on-the-job accidents or injuries receive workers’ compensation death benefits through an employer’s workers’ compensation insurance carrier.
A sole surviving spouse of a worker who dies in a workplace accident will receive burial expenses of up to $7,500 and two-thirds of the average weekly wage of the deceased worker up to a maximum of $500 a week. In total, a spouse with no children will be paid $150,000 total in weekly payments. Benefits will continue until he or she remarries or openly cohabits with a person of the opposite sex. A dependent child of a deceased worker is eligible to receive weekly workers’ compensation payments until he or she reaches age 18 or 21 if they attend college.
