According to the Bureau of Labor Statistics, 5,703 people died in workplace accidents in America during 2006, including 192 people in Georgia. The survivors of those who died because of on-the-job accidents or injuries cannot sue their deceased loved ones’ employers for damages. They can, however, receive death benefits through the employers’ workers’ compensation insurance.
Survivor Benefits
A sole surviving spouse of a worker who dies in a workplace accident will receive burial expenses of up to $7,500 and two-thirds of the average weekly wage of the deceased worker up to a maximum of $500 a week from workers’ compensation. In total, a widowed spouse with no children will be paid no more than $150,000 in weekly payments. Benefits will continue until he or she remarries or openly -lives with a person of the opposite sex. A dependent child of a deceased worker is eligible to receive weekly payments until he or she reaches age 18.
